Welcome to HitherThither. These Terms of Service (“Terms”) govern your use of HitherThither at hitherthither.co (the “Service”). By creating an account or using the Service, you agree to these Terms.
The Service
HitherThither is a travel-planning tool. We help you discover destinations, build day-by-day itineraries, organize trips you already have, and find options to book. We use AI to generate suggestions and content.
What we are — and aren't
HitherThither is a planning and organization assistant. We are not a travel agency, tour operator, or seller of travel, and we do not guarantee that every part of a trip can be booked through us. Where we surface options from third parties (airlines, hotels, activity providers, and partners), your booking and any resulting contract are between you and that provider, subject to their terms and prices. Availability, pricing, and details can change and are not guaranteed by us.
Your account
- You must provide accurate information and keep your login credentials secure.
- You are responsible for activity that occurs under your account.
- You must be at least 16 years old to use the Service.
Your content
You retain ownership of the content you create or upload (itineraries, notes, and photos). By uploading content you grant us a limited license to store, process, and display it to operate the Service for you — including showing a Travel Chronicle to others if you choose to publish it. You are responsible for having the rights to any content you upload and for ensuring it is lawful.
Acceptable use
You agree not to misuse the Service, including by attempting to disrupt it, access it without authorization, upload unlawful or infringing content, or use it to violate the rights of others.
AI-generated content
Itineraries, recommendations, captions, and other AI-generated output may contain inaccuracies. Please verify important details — such as opening hours, prices, visa and travel requirements, and reservations — directly with the relevant provider before relying on them.
Travel involves risk — your safety decisions are yours
Travel and the activities an itinerary may describe — including hikes, swimming, water activities, winter or glacier terrain, driving, and other outdoor recreation — carry inherent risks. We do not operate, supervise, inspect, or guarantee any activity, venue, route, or provider. You are solely responsible for evaluating whether an activity is safe and suitable for you and your companions, for checking weather and local conditions, and for your own preparation and conduct. By using the Service you assume all risks associated with your travel and release HitherThither from claims arising out of activities, venues, routes, or providers described in the Service.
Your travel companions' information
When you add companions to a trip (names, email addresses, travel preferences), you represent that you have each person's permission to share their information with us. Companions can remove their information at any time using the link on their invitation page or by contacting us.
How we make money
Planning is free. When you book flights, stays, experiences, or other services through partner links in the Service, we may earn a commission from the partner at no additional cost to you. See how we make money.
Copyright complaints
If you believe content on the Service infringes your copyright, email hello@hitherthither.co with the work identified, its location, your contact information, and a good-faith statement, and we will respond in accordance with the DMCA, including removing infringing material where appropriate.
Disclaimers
The Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations will meet your expectations.
Limitation of liability
To the maximum extent permitted by law, HitherThither will not be liable for any indirect, incidental, or consequential damages, or for any travel arrangements made with third parties. Our total aggregate liability for any claims relating to the Service is limited to the greater of $100 or the amounts you paid us in the twelve months before the claim arose.
Governing law and disputes
These Terms are governed by the laws of the State of Maryland. Before filing any claim, you agree to contact us and attempt in good faith to resolve the dispute informally within 30 days. Either party may bring qualifying claims in small-claims court.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service and its users.
Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice.
